Understand the Law

Traffic Laws

Traffic laws and regulations can be complex, and can have a significant impact on individuals, including losing your licence, facing fines or even a criminal conviction. The rules are far reaching, with the majority of the population relying on either holding a driver's licence or depending on someone who is a licensed driver. Unfortunately, those who oversee policy in the modern era of law enforcement can arguably appear more interested in the revenue side of enforcement than in actual safety.

Our lawyers at Save U Legal are well equipped to defend and represent clients facing traffic or licensing offences, including serious matters such as predatory driving, furious driving and police pursuits, which carry not only significant licence disqualification periods but also significant prison sentences. If your matter also involves criminal charges, our criminal lawyer Tweed Heads team can assist with both aspects of your case.

Drink Driving

Drink Driving & DUI Lawyers

Drink driving laws have been in force for nearly 40 years, yet unfortunately drink driving remains one of the most regularly prosecuted traffic offences.

Since 2019, PCA (prescribed concentration of alcohol) drink driving laws have tightened further, with the introduction of interlock orders for mid range, first time drink driving offences.

This means that if you return a blood alcohol reading of 0.08 or above, you are now facing a minimum of 12 months on an interlock licence after any disqualification period has ended. For some people, that can mean the difference between staying employed and paying the mortgage, or losing their job with all of the consequences that follow.

As soon as you are charged, we recommend you call us so we can review your options. One of our experienced traffic lawyers at Save U Legal in Tweed Heads may make all the difference.

Speeding and Mobile Offences

Speeding offences affect almost every driver. There are more ways than ever to be caught speeding, with mobile speed cameras and, at times, police positioned in locations, such as just inside a 50km zone, where enforcement can appear more about revenue than safety.

It is easy to accumulate demerit points, which can quickly lead to a suspension letter from the relevant traffic authority. If this happens to you, please give our Save U Legal lawyers a call. Running appeals and defences for speeding offences is what we do, and at the very least we can help you review your options.

We also see strong police enforcement of mobile phone offences. We recently represented a client who was holding a black makeup case, which police mistook for a mobile phone. Do not simply pay the fine, we defend cases like this.

The outcome depends on your blood alcohol reading, whether it is a first offence and the specific PCA category. Penalties can range from a fine and short licence disqualification to an interlock order or, in serious cases, a custodial sentence. Call us as soon as you are charged so we can review your options.
In many cases, yes. Licence suspensions and disqualifications can often be appealed or reviewed, depending on the circumstances and the type of offence involved. Our traffic lawyers can advise you on whether an appeal is available and represent you through the process.
It depends on how many demerit points you have accrued and the severity of the offence. Accumulating too many points, or a serious speeding matter, can result in suspension. We regularly run appeals and defences for speeding offences and can help you review your options.
Not every infringement requires a lawyer, but for anything with the potential to affect your licence, employment or record, early advice is valuable. Given the complexity of traffic legislation, acting early can often help resolve a matter at minimum cost and hassle.
An interlock order requires a device to be fitted to your vehicle that tests your breath alcohol before it will start. Since 2019, interlock orders apply to mid range, first time drink driving offences, and typically run for a minimum of 12 months after any disqualification period ends.
